Can I actually be charged with a DUI/OUI without having had any alcohol?

Yes. This happens regularly. To prosecute such crimes, the government has to prove that you were “under the influence” of alcohol or another controlled substance or the combination of those things together. If the controlled substances you have ingested were validly prescribed, there is still a risk of being charged with a DUI or OUI.

I was just sitting in my car, how can I get a DUI/OUI charge?

A police officer told me my license was automatically revoked. What’s the point of getting an attorney now?

The DMV will only revoke your license “automatically” if you choose not to speak with attorney immediately. You have 7 DAYS from the day of your arrest to request a hearing with the DMV.When you contact our office, we will take action immediately and can sometimes guarantee a hearing and the validity of your license for several months or forever. Don’t assume that because you’ve been arrested your license is lost. Waiting for your court date to contact an attorney will ruin your chances of avoiding a costly revocation.

What if this isn’t my first time with a DUI/OUI or Refusal charge?

Penalties jump dramatically if you have prior convictions with similar offenses. Even if your last offense was 10 years prior, the Municipality of Anchorage will attempt to take away your vehicle. If you’ve had even one prior conviction in the past 15 years, the state-required minimum penalty jumps up to 20 days in jail - not to mention increased fines, license revocations and more. With two prior offenses, the penalty goes up to 60 days in jail. Three prior offenses means 120 days in jail.
